1.1. The Operator

1.2. Account Creation and Acceptance

By checking the acceptance box before creating an account and/or by using our website, you agree to these Terms. To register an account, a valid and operational phone number or a verified email address is required. There is no age barrier for using our service.

2.1. Product Guarantee

We sell only new physical books. We guarantee that all products listed and sold are original, sourced directly from legitimate publishers and distributors. We have a zero-tolerance policy against pirated or counterfeit goods.

2.2. Pricing and Availability

Product prices and stock availability are updated in real-time. The total price displayed on the product page is inclusive of all applicable taxes. Delivery charges are calculated based on the book's weight and displayed separately on the checkout page.

In the event a book's displayed price is incorrect, we reserve the right to cancel the order. If payment has been made, we will immediately reimburse the full amount paid for that product via our admin panel.

2.3. User-Generated Content (Reviews)

Only users who have successfully purchased a product may submit a review or comment. All user-generated content is subject to verification and approval by our administrators before being publicly displayed on the website. We reserve the right to remove any content that is offensive, misleading, or violates third-party rights.

3.1. Order Contract and Cancellation

• An order accepted by us is legally valid and binding as a digital contract under the E-Commerce Act, 2081.
• You may cancel the order anytime before it is dispatched at no cost.
• Once dispatched, cancellation is only permitted for reasonable reasons.

3.2. Delivery Commitments

Our standard estimated delivery timeline is:

• Inside Kathmandu Valley: Within 2 working days.
• Outside Kathmandu Valley: 2 to 4 working days.

3.3. Account Suspension Policy

We reserve the right to suspend or terminate an account without notice for severe violations of these Terms, including:

• Submitting ambiguous or repetitive fake orders.
• Engaging in suspicious activities related to e-commerce practices (e.g., fraud).
• Multiple cancellations of orders after dispatch due to the user's change of mind or failure to pick up the parcel upon delivery attempt.

4.1. Conditions for Return

A product is eligible for return or replacement if it meets the following criteria:

• Product is damaged upon delivery.
• The wrong book was delivered (title, author, or edition).
• Book pages are missing or the product is otherwise defective.
• The delivered edition is outdated compared to the one advertised.

You must notify us of a return/refund request within seven (7) days of the order delivery date.

4.2. Return Shipping Costs and Proof

• If the return is due to a defect or error on our part, the shipping cost of the return will be borne by hamropustak.com.
• If the return is due to the user's change of mind (where the return is accepted), the user shall be responsible for the delivery and return order costs.
• The customer must provide image or video proof of the damaged, unwanted, or incorrect product before the return process can start.

4.3. Refund Process

Refunds will be processed within seven (7) days after the returned books arrive at our warehouse. Refunds will be transferred via bank or e-wallet, as requested by the customer.

5.1. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Nepal.

5.2. Jurisdiction

You agree to submit to the exclusive jurisdiction of the Courts in the Kathmandu Valley, Nepal, for the resolution of any disputes or legal proceedings.

6.1. Grievance Officer

We commit to responding to all complaints promptly and resolving issues within a maximum of fifteen (15) days.

To the maximum extent permitted by law, hamropustak.com and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or services.

Our total liability for any claim relating to a purchase, including a claim related to product authenticity, shall not exceed the amount paid by the customer for that particular order. We are not responsible for delays, errors, or failures caused by factors beyond our reasonable control, including courier delays, payment processor issues, or technical outages.
